Terms of Service

The agreement that governs your access to and use of TrackBooth.

Last updated: 1 January 2026

These Terms of Service ("Terms") form a binding agreement between TrackBooth ("TrackBooth", "we", "us") and the individual or entity that registers for or uses the platform ("you", "Customer"). Please read them carefully. If you are agreeing on behalf of an organization, you confirm you have authority to bind that organization.

1. Acceptance of terms

By accessing or using TrackBooth, creating an account, or clicking to accept these Terms, you agree to be bound by them and by any policies referenced here, including our Privacy Policy, Cookie Policy, Acceptable Use Policy and, where applicable, our Data Processing Addendum. If you do not agree, do not use the platform.

2. The service

TrackBooth is an affiliate tracking and network management platform. It provides tools to manage advertisers, products and offers; create campaigns and Smart Links with traffic routing, weighted offer rotation, caps and fallbacks; track clicks, sessions and conversions; report on performance; manage partners and payouts; and administer team access. The specific capabilities available to you depend on the plan agreed during onboarding.

We may add, modify or remove features over time. Material reductions to core functionality of an active paid plan will be communicated in advance where reasonably practicable.

3. Accounts & eligibility

You must provide accurate registration information and keep it current. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at [email protected] of any unauthorized access. You must be at least 18 years old and legally capable of entering into this agreement.

4. Partner & sub-accounts

The platform allows you to create partner, joint-venture and child accounts and to grant them scoped access through roles and permission profiles. You are responsible for the access you grant, for the conduct of users you invite, and for ensuring those users comply with these Terms and the Acceptable Use Policy. Data isolation between accounts is enforced by the platform, but you remain responsible for configuring visibility appropriately for your network.

5. Fees & billing

TrackBooth pricing is tailored to your volume and configuration and is agreed in a separate order or quote. Unless stated otherwise in that order, fees are billed in advance, are non-refundable except where required by law, and exclude applicable taxes. Late or failed payment may result in suspension of access after reasonable notice. We will give advance notice of any change to recurring fees before a renewal term.

6. Acceptable use

Your use of the platform must comply with our Acceptable Use Policy and all applicable laws, including those governing advertising, data protection, gambling and consumer protection in the jurisdictions you operate in. You are solely responsible for the offers you promote, the traffic you send, and the relationships with advertisers and publishers in your network.

7. Data & privacy

Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf as part of providing the service, for example, end-user data captured through your tracking links, the Data Processing Addendum applies, and you act as the controller of that data while TrackBooth acts as processor. You are responsible for having a lawful basis to collect and process the data you route through the platform.

8. Intellectual property

TrackBooth and its underlying software, design and documentation are owned by us and our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to access and use the platform during your subscription, solely for your internal business purposes. You retain ownership of the data you submit. You may not copy, reverse-engineer, resell or create derivative works from the platform except as expressly permitted.

9. Availability & support

We aim to keep the platform available and performant, but do not guarantee uninterrupted access. Planned maintenance will be scheduled to minimize disruption where possible. Support levels, including any service-level commitments, are defined by your plan and order.

10. Disclaimers & limitation of liability

The platform is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We are not responsible for the commercial outcomes of your campaigns or the conduct of advertisers, publishers or partners.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to these Terms will not exceed the fees you paid to us in the twelve months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

11. Term & termination

These Terms apply for as long as you use the platform or have an active subscription. Either party may terminate as set out in the applicable order, or for material breach that remains uncured after reasonable written notice. On termination, your right to access the platform ends; we will make your data available for export for a limited period as described in the Privacy Policy, after which it may be deleted.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the platform or by email before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.

13. Contact
